The
Delhi High Court has created an Intellectual Property Division (IPD) to deal
with all matters related to Intellectual Property Rights (IPR).
The
Tribunals Reforms (Conditions of Services and Rationality) Ordinance 2021
abolished the boards and appellate tribunals created under various laws
relating to the conduct of IPRs.
The
decision to form the IPD was taken by the Chief Justice of Delhi High Court,
D.N. Based on the recommendations of the committee headed by Patel. The
committee also included Justice Pratibha M Singh and Sanjeev Narula. The
committee has submitted its report regarding the laws relating to both IPR and
non-IPR subjects.
The
High Court has said in a statement that the IPD Bench will continue to be
notified by the Chief Justice from time to time. At the same time, a special
IPD bench will also be constituted to look into such matters.
The
high courts will now have the right to look into the cases pending under
various boards, tribunals and new cases, the statement said.
The
Tribunals Reforms (Conditions of Services and Rationalization of Services)
Ordinance, 2021 and with its coming into force, the Boards and Appellate
Tribunals constituted under various laws relating to the conduct of IPRs have
been abolished. Keeping this fact in view, it was decided to constitute a
two-member committee and IPD.
