The
Supreme Court refused to entertain the plea of some doctors from Uttar Pradesh.
By filing the petition, the doctors had sought a direction to the state
government to give NOC for pursuing postgraduate diploma courses outside the
state. The top court said that this is a policy matter and at present, we
cannot interfere in it.
A
bench of Justice Navin Sinha and Justice Dinesh Maheshwari observed that the
petitioner doctors have not only sought NOC but also challenged the policy. In
fact, on May 6, in view of the second wave of Corona, the Uttar Pradesh government
had issued a notification saying that doctors working in the state cannot
currently take study leave for further studies outside the state.
The bench told senior advocate Siddharth Dave, appearing for the petitioner,
that he can challenge this policy of the state government in the High Court.
The bench said that if the petition is filed, we request the High Court to
dispose of it expeditiously.
During the hearing, Additional Advocate General Garima Prasad, appearing for
Uttar Pradesh, told the bench that in view of the situation of Corona, the
state government has banned doctors from going out and studying. The state
government believes that there is a great need for doctors in the state right
now. The petitioner doctor was demanding NOC for studies in AIIMS.
