The
State Law Commission has prepared the draft of UP Population (Control,
Stabilization and Welfare) Bill-2021. In this, there is a proposal to ban from
applying in government jobs to contesting elections in local bodies if there
are more than two children. There is also mention of not giving benefits of
government schemes. The commission has uploaded the draft on its website
http://upslc.upsdc.gov.in/. Public opinion has been sought by July 19.
The
Law Commission has presented this draft at a time when the Yogi government is
going to issue a new population policy after two days. CM Yogi Adityanath has
especially emphasized on adopting community centric awareness program in this.
However, the commission says that it is preparing the draft of the law on its
own. Due to limited resources and high population in UP, it is necessary to
take these steps.
If
limited to only two children, parents who are in government jobs will be given
many facilities including increment, promotion. If the law is implemented, then
within a year, all government officials-employees and elected representatives
of local bodies will have to give an affidavit that they will not violate this
policy. It is proposed to cancel the election if the rule is broken. There is
also a proposal to stop promotion and dismissal of government employees.
Less than two children, more
facilities
Those
parents who limit the family to only two children, who are in government
service and undergo voluntary sterilization, will be given many facilities like
two additional increments, promotion, exemption in government housing schemes,
increase in employer contribution in PF. It is also proposed to provide water,
electricity, house tax, home loan exemption and other facilities to couples
with two children who are not in government jobs.
At
the same time, the children of parents who have done voluntary vasectomy on one
child will be given priority in free treatment, education, insurance,
educational institutions and government jobs for 20 years. It is suggested to
give four additional increments to the couple having government jobs. If the
couple is below poverty line and undergoes voluntary sterilization only after
one child, then it is also recommended to give a lump sum of Rs.80 thousand for
their son and Rs.1 lakh for daughter.
Violation results harsh repercussions
If
the law is implemented, within a year, all government officials-employees,
elected representatives of local bodies will have to give an affidavit that
they will not violate it. They have only two children at the time of the
enactment of the law and if they produce a third child after giving the affidavit,
it is proposed to cancel the election of the representative and not to contest
the election.
There
is a recommendation to stop promotion and even dismissal of government
employees. However, if there is a pregnancy at the time the Act is in force or
there are twins at the time of second pregnancy, then such cases will not come
under the purview of the law. If someone’s first, second or both children are
disabled, then he too will not be denied the facilities on the third child. The
adoption of a third child will also not be barred.
Special provisions on polygamy
The
commission has made special provisions in the draft for couples who have more
than one marriage under religious or personal law. If a person performs more
than one marriage and has more than two children from all the wives, then he
will also be deprived of the facilities. However, every wife will be able to
take advantage of the facilities. On the other hand, if a woman marries more
than one and has more than two children from different husbands, she will also
not get the facilities.
Justice
N Mittal, chairman of the State Law Commission, says that population policy
does come, but there is no law to stop it. In the policy, you can give grants
and incentives but cannot impose penalties or restrictions, so the commission
has prepared a draft of the law. After finalizing the suggestions, we will
submit it to the state government.
